OPINION and JUDGMENT
DALTON, Chief Judge.
This case comes before the court on a petition for a writ of habeas corpus, filed in forma pauperis by Jimmie Blankenship, a state prisoner, pursuant to 28 U.S.C.A. § 2241. The petition was filed on November 29,1968.
The petitioner is currently being detained in the Virginia State Penitentiary pursuant to a judgment of the Circuit Court of Buchanan County of January 23, 1963, wherein the petitioner was convicted of the crime of robbery and sentenced to twenty-five years confinement.
