BACKGROUND

By an original Superior Court complaint of December 1, 1994, the plaintiff Dennis Salmon alleged that, on December 4, 1991, he had properly stopped his car at a railroad crossing in the City of Worcester; that three boxcars from a train operated by the Providence and Worcester Railroad had come loose and collided with his automobile; and that he had suffered serious personal injuries.
