This action was brought by the plaintiff, as administrator of his deceased wife’s estate, to recover damages occasioned by reason of her death, allegedly caused by malpractice occurring during the delivery to her of a child. The delivery took place at the hospital of the defendant, Maimonides Hospital of Brooklyn, hereinafter referred to as “ Maimonides ”, The defendant Prostkoff was the physician who performed the delivery, the defendant Evans was the nurse-anesthetist who administered the anesthetic, and the hospital was brought in under the theory of respondeat superior, the nurse having…
