KORMAN, District Judge.

Petitioner Stephen Gagne seeks habeas corpus relief from his 1984 New York State conviction for intentional and felony murder and first degree burglary. After a jury trial, petitioner was sentenced to two concurrent terms of twenty-five years to life and one concurrent term of twelve and one-half to twenty-five years. The Appellate Division affirmed the conviction on April 27, 1987, People v.
