Plaintiff-appellant Haitham Khaled Bouzo appeals from a judgment entered April 6, 1995 in the United States District Court for the Southern District of New York, Nina Gershon, Magistrate Judge,1 that granted the motion of defendant-appellee Citibank, N.A. (“Citibank”) for summary judgment and dismissed Bouzo’s amended complaint after concluding that a document issued to Bouzo by Citibank was not a letter of credit under Article 5 of the New York Uniform Commercial Code (the “N.Y.U.C.C.”).
