The Common Pleas Court having sustained a demurrer to the amended petition, it was dismissed. Prom that judgment this appeal on questions of law was taken.
The petition alleges that by the will of John A. Neidecker, a legacy of $500 was given to plaintiff, his granddaughter. His widow, the defendant, Julia Neidecker, was appointed executrix of v the will, and, having paid all of the debts of the estate, March 23, 1937, filed her final account which was approved by the Probate Court June 16, 1937.
