The certificate of the Honorable Court of Civil Appeals discloses the following facts:

On May 14, 1914, Mrs. Laura Stewart Hardy died in the County of Harris, in the State of Texas.

On May 15, 1914, E. B. Stewart filed in the county court of Montgomery County, Texas, an application for letters of administration on the estate of Mrs. Laura Stewart Hardy, deed., which contained all statutory averments to show jurisdiction in that court to grant the letters. The application also showed a necessity for the appointment of a temporary administrator of the estate.
