The original suit out of which the present litigation arises, was a bill brought by Thomas A. Galt, against Michael Moriarty, plaintiff in a certain execution, and Thomas S. Beach, sheriff, to prevent defendants from casting a cloud upon the title of certain real property which complainant claimed to own in fee simple.
