This matter was before the Supreme Court pursuant to an order directing both parties to appear and show cause why the issues raised in this appeal should not be summarily decided. The plaintiff in this case has appealed from a Superior Court justice’s granting of a motion for summary judgment by the defendants on a finding that the plaintiff, *1198Russell S.
