Defendant, David Harris, was convicted of first degree murder and attempted armed robbery in 1995 and sentenced to death. On direct appeal, this court affirmed defendant’s conviction and sentence. People v. Harris, 182 Ill. 2d 114 (1998). Defendant thereafter petitioned the Cook County circuit court for relief pursuant to the Post-Conviction Hearing Act (725 ILCS 5/122 — 1 et seq. (West 1998)).
