Appeal from a judgment of the superior court for King county, Ralston, J., entered April 24, 1920, upon the verdict of a jury rendered in favor of the plaintiffs, in an action for damages for fraud.

This is an action by the respondent for the recovery of $5,000, as damages against the appellants, upon the ground that appellants agreed to supply *682$100,000 in cash as the capital of a corporation in which respondent was to receive stock of the value of $5,000.

Respondent further plead that appellants were to supply a working capital of $50,000, but his recovery is predicated upon the failure to make the shares received by him worth their par value.
