This is an action for malicious prosecution. The prosecution was instituted by D. A. Pritchard, an agent for the State Life Insurance Company, with limited authority, as an incident to an attempt by Pritchard to collect a debt due by the appellee’s deceased husband to the in surauce company. Pritchard and the insurance company were defendants to' the action, and both separately requested, but were refused, a directed verdict.
