WILLIAMS, Justice.

This is an appeal from an order of the District Court of Bowie County sustaining a plea in abatement to appellants’ cause of action and dismissing same. On March 2nd, 1935, appellant filed suit against appel-lee on a fire insurance policy covering her dwelling house and household furnishings located in Texarkana, Bowie County, Texas, which had theretofore been damaged and destroyed by fire; that said damages .and destruction amounted to the face of said policy, namely, $1,000; and that appellee had an agent residing in Bowie County, Texas.
