HENDERSON, Judge.
Appellant was convicted of the theft of a horse, and given five years in the penitentiary, and prosecutes this appeal. The indictment charges that the horse alleged to have been stolen was the property of and in the possession of an unknown owner. The evidence tends to show that the animal in question, being a gray horse, ran on the range in Kimball County, and generally with the horses belonging to Rogers Bros.
