CONNER, Chief Justice.

On November 17, 1898, judgment was rendered in a Justice Court in favor of appellee for certain rents claimed by him. Appellant filed motion for new trial, but no action was taken thereon in the Justice Court until Monday, November 28, 1898, when such motion was overruled. Thereafter, on December 7, 1898, appellant filed with the justice his appeal bond, which was duly approved. In the County Court motion was duly made that the appeal be dismissed on the ground, among others, that the appeal bond was filed too late, which motion was sustained and the appeal dismissed.…
