Appellees were plaintiffs and appellant defendant in the trial court, and we will so designate the parties. Roy Dunaway Murph, Jr., and Mary Alice Murph, minors, brought this suit by next friend in the district court of Jasper county, to recover. upon a policy of life insurance issued by the defendant to their father, Roy Dunaway Murph, deceased, for the principal sum of $5,000, and in which policy they were named as beneficiaries.
