acting Associate Justice in place of Justice Gary, disqualified. This action for claim and delivery has already been before this Court, see 47 S. C., 488, where.the facts are sufficiently set forth. A new trial having been granted, the case was heard at the October term at Abbeville, 1897, the result being a mistrial. At the next October term, 1898, -the case came on for its third trial, at Abbeville. After the plaintiff had rested his case on his testimony in chief, one of the defendants, A. J.
