"The action is upon a judgment of the Court of Common Pleas of the state of Ohio and was tried before the court without a jury. The complaint alleges the recovery of the judgment and "that the Court of Common Pleas of the State of Ohio is a court of general jurisdiction. The answer contains a general denial and alleges that the note upon which the judgment was rendered was without consideration. From the record of the judgment given in evidence it appears that the judgment was given upon a note dated January 4,1909, payable one year after date, made by the defendant to the plaintiff as payee,…
