OPINION

BUSSEY, Judge:

Appellant, Ronnie James Chance, hereinafter referred to as defendant, was *413charged, tried and convicted in the District Court, Woods County, Case No. CRF-73-58, for the offense of Unlawful Delivery of Marijuana, in violation of 63 O.S.1971, § 2^-01 (B-2). He was convicted jointly with co-defendant Gary Lee Taylor. His punishment was fixed at a term of two (2) years’ imprisonment and a fine of Two Hundred and Fifty ($250.00) dollars. From said judgment and sentence a timely appeal has been perfected to this Court.
