MEMORANDUM OPINION

MYRON H. THOMPSON, District Judge.

On June 21,1989, this court preliminarily found that the Chief of Police for the City of Montgomery, Alabama had refused to consider and select one of four police officers as a “deputy chief designate” for the city’s police department because of those officers’ prior connections with these consolidated cases which over the years have addressed charges of sex and race discrimination in the department.
