Henry Coats was indicted, tried before a jury, and convicted of the crime of murder in the first degree. From the judgment of conviction he has duly prosecuted an appeal to this court.
R. L. Ferguson was the city marshal of Osceola, and also deputy sheriff of Mississippi County, Arkansas. On the afternoon of April 3,1911, in company with Bob Dean, also a deputy sheriff of Mississippi County, he attempted to arrest the defendant, Henry Coats, which resulted in the death of Ferguson and the wounding of Dean.
