OPINION AND ORDER OF COURT

MOYE, Senior District Judge.

Brandon A. Jones, a/k/a Wilbur May, petitions this court for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. For the reasons set forth in Parts III, A-H, of this opinion, the court finds petitioner’s claims of alleged error during the guilt/innocence phase of his trial to be without merit. For the reasons set forth in Part IV of this opinion, however, the court finds that the state trial court committed constitutional error in the sentencing phase of the petitioner’s trial.
