Leon B. White, by his next friend, brought a petition against the Atlanta, Birmingham & Atlantic Bailroad Company, to recover damages for a personal injury. A similar suit had previously been brought against the Atlantic & Birmingham Railway Company, which was voluntarily dismissed, and the costs had been paid. The petition alleges, that the plaintiff, who was a child of tender years, was employed as messenger boy in the office of the Postal Telegraph-Cable Company at Douglas, Georgia; that the telegraph company’s office is at the office of the agent of the defendant railroad company, and the…
