WALTERS, Chief Judge.

The issue at trial in this action was whether it was the homeowner or the contractor who breached a written contract to remodel several rooms in a home. The jury returned a special verdict finding that although the contractor had not substantially performed under the contract, he had been prevented from doing so by the homeowner. The jury awarded $2,956.40 in damages to the contractor, essentially the balance of the contract price. The homeowner filed a motion for judgment n.o.v. or for a new trial, which was denied.
