Hotchkiss, J.:

The action was brought under the Labor Law. The appellant was the general contractor for the erection of a high building of steel construction, and the plaintiff’s intestate was a workman in its employ. For the use of itself and its subcontractors, indiscriminately, as them needs might require, defendant had installed a double hod hoist to hoist building material to the various floors.
