INTRODUCTION
This case was removed to this Court from a Puerto Rico Court of First Instance by Defendants Caribe Ford, Inc. (“Caribe Ford”), Robert Fronrath, Gary Fronrath, Steven Westphal and his wife, Gwen West-phal (collectively hereinafter “Defendants”), on November 12, 2002, a day before a scheduled emergency hearing was to take place in state court for the attachment of Plaintiffs collateral.
