MEMORANDUM OPINION AND ORDER
WILLIAM E. DOYLE, District Judge.
This action was commenced on July 22, 1966, in the Probate Court for the City and County of Denver, Colorado. It is in a sense a companion to Civil Action No. 66-C-359 in this Court wherein two of the defendants named, Bruce R. Rip-pey and A. Gordon Rippey, are plaintiffs. On August 9, 1966, these two individuals *719filed, pursuant to Title 28 U.S.C. § 1441, a petition for removal. Thereafter the plaintiff Bank moved to remand. Bruce R. Rippey and A.
