This is a writ of error to revise an order of the circuit court based upon a state of facts found and reported by the judge, and the charge of error is that the order is not warranted by the facts. The case is explained by the finding which appears in the margin.*

*95Tbe controversy arises on tbe last clause of Oomp. L. § 4377, subd. 6, prescribing tbe course of distribution in a ■class of cases of wbicb tbis is one. It reads as follows:

“ In any other case tbe residue, if any, of tbe personal estate shall be distributed in tbe same proportions, and to tbe same persons, and for tbe same purposes,…
