This is an action of contract by a trustee in bankruptcy to recover the fair value of certain real estate alleged to have been conveyed by the bankrupt while insolvent, within four months of the filing of an involuntary petition in bankruptcy against him, and with intent to prefer the defendant at the expense of his other creditors, the defendant at the time knowing, or having reasonable cause to know, that the bankrupt was insolvent and unable to pay his debts and that such conveyance would operate as a preference.
