Gayle Rogers, doing business as Gayle Rogers & Sons Gravel Company, brought suit against Labarama, Inc., seeking to recover the balance due on a contract between plaintiff and defendant under which plaintiff agreed to construct a dredge boat with certain attached equipment for a total consideration of $10,500, payable $2,000 on delivery to the job site, $4,000 when the dredge boat and equipment was producing gravel, and $4,500 balance to be paid in equal quarterly payments thereafter, without interest.
