Facer Insurance Agency, Inc. (Facer) appeals from the district court’s1 order granting summary judgment to the plaintiff George Fabe (Fabe), 588 F.Supp. 1330. Fabe is the Superintendent of Insurance of the State of Ohio, and appears here as liquidator of Proprietors’ Insurance Company (PIC), an Ohio corporation with its principal place of business in Ohio.
