—In a proceeding pursuant to CPLR article 75 to vacate an arbitration award dated July 2, 1998, the petitioner appeals from (1) an order of the Supreme Court, Orange County (Owen, J.), dated January 14, 1999, which denied its petition and granted the respondent’s cross petition to confirm the award, and (2) a judgment of the same court, entered February 8, 1999, upon the order.

Ordered that the appeal from the order is dismissed; and it is further,

Ordered that the judgment is affirmed; and it is further,

Ordered that the respondent is awarded one bill of costs.
