This matter comes before the Court pursuant to the Motion For Relief From Judgment *645Due to Mistake filed by American Freight System, Inc. (“plaintiff’). The motion alleges in pertinent part that:

the Reply Brief of AFS to the Supplemental Submission was not delivered to the Clerk of this Court in Topeka, Kansas, and therefore it would appear that it was not made available to the Court for review prior to entry of the Final Judgment....
