T 1 On September 22, 1999, Victor Cornell Miller, Appellant, was charged, along with co-defendant John Fitzgerald Hanson, with two counts of First-Degree Malice Murder, in violation of 21 O.S.Supp.1998, § 701.7(A), or alternatively, First-Degree Felony Murder, in violation of 21 O.S.Supp.1998, § 701.7(B) (Counts I & II), in the District Court of Tulsa County, Case No. CF-1999-4583.
