The appellant, Terry Rogers, was convicted of committing an assault and battery on Jamie Randolph with intent to kill and murder him with a deadly weapon, to-wit, a knife. He was thereupon sentenced to serve a term of three years in the state penitentiary. On this appeal he assigns as error (1) that the trial court permitted the introduction of evidence to contradict him on immaterial matter; (2) that he was entitled to a requested peremptory instruction to the jury to find him not guilty of assault and battery with intent to kill and murder; and (3) that the court erred in overruling his…
