MORROW, Presiding Judge.

The offense is murder; penalty assessed at confinement in the penitentiary for fifty years.

That Ocie Pierce was killed by the appellant on the 17th day of January, 1933, was proved by the state’s testimony, as well as that of the appellant, who testified in his own behalf. It is claimed by the appellant that he acted in self-defense in firing the shots which took the life of the deceased.
