Suit to set aside letters patent to certain land under water.

This is an action brought by the attorney-general in the name of the People of the State of New York to set aside letters patent issued in 1823 to James Swan, upon the ground that the patentee was not the owner of the lands adjacent to the land under water comprised in the letters patent at the time of their issuance.
It appears that Swan held his lands under title derived from one Van Duzer. While the deeds speak of the lands as “ fronting on the bay of Hudson’s river,” they'are also described as being bounded in front “ by the public highway,” and the fact is that there was a strip between…
