The plaintiff in error was indicted at the October term, 1846, of the Warren county circuit court, for the murder of one-Donnahoo, whose Christian name was unknown. This was an indictment tried in the circuit court of Hinds, upon which William H. Boles, the plaintiff in error, was convicted of the murder of one Donnahoo. A motion was made for a new trial, which was overruled, and the case having been removed into this court, we are asked to reverse the judgment for errors alleged to have occurred during the progress of the trial below.
We will proceed to consider the objections pressed upon our attention in the order in which they were discussed.
