The opinion of the court was delivered by

McEnery, J.

The accused was tried on a charge of murder, and convicted of manslaughter, and was sentenced to hard labor for a period of ten years. From the verdict thus rendered and sentence thus imposed, he has appealed on grounds stated in two bills of exception to portions of the written charge of the trial judge.

In the first bill it is urged that the district judge trenched upon the facts of the ease, and intimated his opinion as to the legal bearing of the evidence to the prejudice of the accused.
