Appeal from a judgment of the County Court of Albany County (Lynch, J.), rendered October 11, 2013, upon a verdict convicting defendant of the crimes of grand larceny in the second degree and identity theft in the first degree.
Defendant was charged in an indictment with grand larceny in the second degree and identity theft in the first degree as a result of accusations that, from July 2011 to January 2013, he used the victim’s ATM card to make substantial unauthorized withdrawals from her checking account.
