In making a division of the marital property in this case the trial court failed to apply the most recent amendment to K.S.A. 60-1610(b)(l), effective January 1, 1983. It failed to give consideration to the “dissipation of assets” in making a division of property in the divorce action in accordance with the admonition of the legislature. Accordingly, in my opinion, the trial court abused the exercise of its power of discretion in making an award to the plaintiff which is confiscatory of the portion of the property awarded to the defendant.
