Appellee Owen filed his petition in this case on March 29, 1929, naming as defendants M. P. Harbert, justice of the peace, precinct No. 1, Knox county, W. A. Holt, constable of said precinct, and J. H. Atterbury. He alleged that more than a year prior thereto At-terbury recovered a judgment against him in the justice court of said precinct for the principal sum of $74.10, from which judgment he gave notice of appeal to'the county court, and within ten days from the rendition thereof delivered* to Harbert, justice of the peace, an appeal bond in the amount and conditioned as…
