LUONGO, Chief Judge.

This is an action under 42 U.S.C. § 405(g) to review the final decision of the Secretary of Health and Human Services (Secretary) denying plaintiff’s claim for disability benefits. The magistrate, to whom the matter was referred for report and recommendation, reports that (1) there is not substantial evidence to support the Secretary’s findings and (2) the Secretary was not entitled to rely on the medical-vocational guidelines contained in 20 C.F.R.
