—In an action for a divorce and ancillary relief, the plaintiff appeals from an order of the Supreme Court, Nassau County (Yachnin, J.), dated March 22, 1994, which granted the defendant’s motion to vacate a judgment of divorce entered November 5, 1992, upon his default.

Ordered that the order is modified by deleting the provision thereof which vacated that portion of the judgment of divorce which granted a divorce to the plaintiff upon the grounds of cruel and inhuman treatment by the defendant; as so modified, the order is affirmed, without costs or disbursements, and the matter is remitted…
