*1220Edward J. Timcho, Jr., (Claimant) petitions for review of an adjudication of the Workers' Compensation Appeal Board (Board) dismissing his petition for reinstatement of benefits under the Workers' Compensation Act (Act).1 In doing so, the Board affirmed the decision of the Workers' Compensation Judge (WCJ) that Claimant had already litigated to finality the modification of his disability status from full to partial and failed to raise the issue of the constitutionality of his impairment rating evaluation (IRE) in that litigation.
