Petitioner Lonnie Earl Johnson, convicted of capital murder in Texas and sentenced to death, requests this Court to issue a Certificate of Appealability (COA) pursuant to 28 U.S.C. § 2253(c)(2). Johnson challenges only his death sentence. He raises the following issues: (1) the prosecution suppressed material exculpatory evidence during the sentencing phase in violation of due process; (2) due process and equal protection required that his jury be instructed regarding parole laws; and (3) the Texas capital sentencing scheme’s failure to require the prosecution to prove beyond a…
