The State appeals from an order of the Rice District Court discharging the defendant in this criminal case, James T. Grimes, due to the State’s failure to comply with the Kansas speedy trial statute, K.S.A. 1980 Supp. 22-3402. A chronological *144statement of the facts is necessary to an understanding of the issues.
