On August 9, 1912, Charles C. Hopkins, appellee, and George S. Patton, appellant, entered into a contract whereby appellee agreed to convey by warranty deed to appellant the south-east quarter of section 32, in town 25, range 4, in McLean county, and to furnish an abstract of title thereto brought down to October 1, 1912, showing a merchantable title clear of all encumbrances except a trust deed for $13,000, and appellant agreed to pay for the land $33,600, of which $1000 was paid in cash.
