delivered the opinion .of the Court:

An ordinance was duly passed by the city council for the purpose of extending Dearborn street from its intersection with Jackson street to Twelfth street, in Chicago. Application was made to the Superior Court of Cook county for the appointment of commissioners, pursuant to the requirements of the statute, to make an assessment of the benefits and damages which would be sustained by opening the street.
