Appeal from an order of the Supreme Court (Platkin, J.), entered December 9, 2014 in Albany County, which granted defendant’s motion for, among other things, summary judgment dismissing the complaint.
Plaintiff and defendant own adjoining parcels located in the Town of Westerlo, Albany County. The northern border of defendant’s parcel forms the southern border of plaintiff’s parcel. This dispute concerns a 10-foot-wide strip of land (hereinafter the strip) running parallel with the border between the two parcels.
